Welcome to Pomp Team Store, a service operated by Pomp Cheer (“Pomp,” “we,” “us”). These Terms of Service (the “Terms”) govern your access to and use of the Pomp Team Store website, apps, and services (together, the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You're responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
2. Using the Service
You may use the Service to design, launch, and operate a custom merch store for your team, school, club, or organization. You agree not to:
- Upload designs, artwork, names, or logos you don't have the right to use
- Use the Service for unlawful, infringing, or harmful purposes
- Attempt to reverse-engineer, scrape, or disrupt the Service
- Resell or repackage the Service to third parties without our written consent
3. Your Content & Designs
You retain ownership of artwork, logos, names, and other materials you upload (“Your Content”). By submitting Your Content, you grant Pomp a worldwide, non-exclusive, royalty-free license to host, reproduce, print, display, and ship products incorporating Your Content for the purpose of operating your store and fulfilling orders. You represent that you have all rights and licenses necessary to upload Your Content.
4. Orders, Payments & Fulfillment
Pomp handles payment processing, production, and shipping for orders placed through stores built on the Service. Prices are set by you (as the store owner) and include product cost, applicable fees, and your markup. Payouts, refunds, and production timelines are governed by the applicable payment and fulfillment policies disclosed at checkout and in your dashboard.
5. Fees
Creating a store is free. Pomp earns revenue from product cost and platform fees applied to each order, as disclosed in your dashboard. We may change fees with reasonable notice.
6. Intellectual Property
The Service, including all software, branding, and content provided by Pomp, is owned by Pomp or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in Pomp's intellectual property except as necessary to use the Service.
7. Termination
You may close your account at any time. We may suspend or terminate your access if you violate these Terms, abuse the Service, or if required by law. Orders placed before termination will continue to be fulfilled where possible.
8. Disclaimers
The Service is provided “as is” and “as available.” Pomp disclaims all warranties to the fullest extent allowed by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, Pomp will not be liable for indirect, incidental, consequential, or punitive damages, or for lost profits or revenue arising out of or relating to the Service.
10. Changes
We may update these Terms from time to time. If we make material changes, we'll notify you via email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance.
